Marlin 1889??

A friend has a Marlin lever action marked as follows:
38W on the octagonal barrel. 24" barrel.
Serial number: 96359
Patent dates: October 11, 1887, April 2, 1889.
I think this is a Black Powder Marlin 1889. Is this correct?

Not for sure. It's a serial number that could indicate a very early 1894 before they started marking the top tang, or a late 1889. The real key is if it has a lever catch. No lever catch, it's not an 1889. With lever catch, it's an 1889.
